DKBmed is an integrated, non-accredited, continuing medical education company operated by an experienced team of medical education professionals and the finest faculty in the country. Our goal is to provide health care professionals with the most effective medical education to ensure optimal patient care, and to close identified practice gaps.

The Tufts University School of Medicine (TUSM) Office of Continuing Education (OCE) was established over 30 years ago primarily to serve the continuing education needs of Tufts-affiliated physicians.

Today, the OCE sponsors, develops and implements continuing education (CE) programming that addresses health care improvements and enhances the professional development of both TUSM-affiliated and non-TUSM physicians, nurses, pharmacists and other members of the health care team.

In recent years, TUSM OCE became a nationally accredited provider for nurses (American Nurses Credentialing Center Commission on Accredidation) and pharmacists (Accredidation Councial for Pharmacy Education) as well.

Since 2005, Tufts Health Care Institute (THCI) has managed the TUSM OCE. THCI, a not-for-profit educational organization, was established in 1995 as a collaborative venture of the Tufts University School of Medicine (TUSM) and Tufts Health Plan (THP), a leading nonprofit health plan in Massachusetts.

Together, OCE and THCI develop innovative educational activities encompassing the ABMS/ACGME competencies. The OCE employs multiple educational formats ranging from Regularly Scheduled Series at Tufts-affiliated teaching hospitals to live courses and webcasts, Internet point-of-care CME, and enduring web-based, computer-based and print educational activities.

Throughout our continuing education activities, OCE strives to engage learners through interactive teaching, case-based learning, reflective exercises, and self-assessments, as appropriate.

For live, accredited conferences, participant lists and contact information may be available in the course materials. This information is provided so that participants may maintain contact. The Office of Continuing Education (OCE) will never sell participant lists to outside parties. In rare instances when the OCE wishes to share participant information with a third party, OCE will only do so if participants grant explicit permission to have the contact information shared.

Internet Privacy

Tufts Health Care Institute (THCI) is committed to helping physicians and other healthcare professionals practice comfortably and effectively in a high-quality, cost-effective health care environment. We work to ensure that internet privacy of our users is protected. The following is our policy regarding user internet privacy.

Collection of Personal Information

All of the personal information that is collected during the registration process is kept in a secured area and is password-protected. Your information will be kept on file for an indefinite period of time unless you notify THCI that you would like your information deleted. To delete your information, you must send an e-mail to THCI at [email protected], requesting that all personal information be removed. We will delete your personal information from our databases within several business days of receipt of your request; however, it will take approximately six weeks to ensure that all personal information is deleted from archival media used to ensure the integrity of our databases.

E-Mail Messages

Tufts Health Care Institute may send you periodic messages about system, program and product announcements. You will receive these messages unless you register to limit or decline these services as discussed below.

Limitation on Use of Collected Information

Tufts Health Care Institute will not sell or exchange users' personal information and registered e-mail addresses to any other party or organization without the explicit prior permission of the user. Collected information will not be shared with other third parties unless THCI specifically identifies otherwise at the time the information is collected.

Update/Delete/Deactivate E-Mail Services

Users may request changes to e-mail services delivered by Tufts Health Care Institute, including requests to receive no e-mail services. Users can send a request to have their email service eliminated by contacting Tufts Health Care Institute support at [email protected]. However, once the E-Mail address is deleted, the user loses access to valuable information assets delivered via E-mail.

Log Files

Tufts Health Care Institute records certain nonpersonal information in our web logs, such as Internet protocol address, browser type (e.g., whether you use Netscape or Internet Explorer), the page requested and the time of each page request. We collect this nonpersonal information to track times to manage resources, analyze trends to provide better service, and to conduct other site administration. This demographic information is not connected to any personally identifiable information, such as a name or address and will be used only to provide better, more targeted services. This information, if shared, will be shared only in aggregate form, with select third parties only, unless THCI specifically identifies otherwise at the time the information is collected. Tufts Health Care Institute will never release any user's personally identifiable information to third parties unless subpoenaed or ordered by court of law, or to protect the security and safety of our visitors and our web site.

Security

Access to computer data and files at Tufts Health Care Institute is secured by password coding and internal file security. THCI uses reasonable efforts to ensure that all personal information is protected from Internet access in a secured area and can only be accessed by authorized Tufts Health Care Institute employees. Users should be aware that e-mail is not necessarily secure against interception and that any information considered sensitive by the user should be delivered to THCI by postal mail or telephone.

Changes to This Policy and Use of the Web Site

Although Tufts Health Care Institute does not intend to change its privacy-confidentiality policy, it reserves the right to do so at any time. PLEASE READ THE FOLLOWING TERMS CAREFULLY. YOU MUST AGREE TO THE TERMS OF THIS iCases MOBILE APP END USER LICENSE AGREEMENT (“AGREEMENT”) IN ORDER TO INSTALL AND USE THE iCases MOBILE APP. BY CLICKING THE “ACCEPT” BUTTON YOU AGREE TO BE BOUND TO THE TERMS OF THIS AGREEMENT. YOU MAY NOT USE THE iCases MOBILE APP IN ANY WAY UNLESS YOU HAVE ACCEPTED THE TERMS AND CONDITIONS OF THE AGREEMENT AS SET FORTH BELOW. DKB MED LLC RESERVES ALL RIGHTS NOT EXPRESSLY GRANTED TO YOU UNDER THIS AGREEMENT.

  1. DKBmed Applications

    “DKBmed Content” means the content supplied via the App, including but not limited to the educational, scientific and literary and audio visual materials contained therein, along with all related copyrights, trademarks. To the extent any App provides the End User with the opportunity to participate in any Continuing Medical Education (“CME”) coursework, in such instance the DKBmed Content shall also include any testing, tracking and/or other analytic tools necessary for completion and documentation of such CME coursework.

    The iCases Mobile App. (“App”) means the DKBmed application for personal electronic devices and any software included therein, whereby the user may access the DKBmed Content, including but not limited to all CME Apps.

    “CME App” means a DKBmed App that a health care professional may download and use to seek to obtain CME credit. Prior to running any CME App, the health care professional must register with DKBmed as set forth in the applicable CME App. DKBmed will share the registration information with the accredited CME provider, who will be responsible for issuing any CME credit and attendant certificate of successful completion of the CME materials.

  2. License

    Subject to the terms and conditions contained in this AGREEMENT, DKBmed grants, and YOU accept, a non-exclusive, non-transferable (except as provided herein), non-sublicensable, revocable limited license and right to install and run the App and to access the DKBmed Content, solely for your own non-commercial, personal/professional purposes on any Apple® iPhone®; Apple® iPod touch®, and Apple® iPad™ that the YOU own or control and as permitted by the Usage Rules set forth in the App Store Terms of Service (the “License” or “LICENSED APPLICATION”) You acknowledge and agree that the App will use your wireless network to send and receive data, and that your mobile operator may bill YOU the App airtime, data and/or usage fees.

    DKBmed owns all right, title, and interest in the App and the DKBmed Content including, but not limited to, all patent, copyright, trade secret, trademark and other intellectual property rights associated therewith, and all title to such rights shall remain solely in DKBmed. Unauthorized copying of the App or the DKBmed Content, or failure to comply with the above restrictions, will result in automatic termination of this AGREEMENT and all licenses granted hereunder, and will make available to DKBmed all legal and equitable remedies for breach thereof.

  3. Restrictions

    Except as provided in Paragraph 2, YOU have no right to access or use the App and/or the DKBmed Content. For purposes of clarification, and without limiting the foregoing, YOU may not: (i) replicate, or make or distribute copies of the App, the DKBMed Content, or any portion of either of the foregoing; (ii) assign or transfer (electronically or otherwise) copies of the App and/or of the DKBmed Content; (iii) rent, lease, sell, assign, loan or sub-license access to the App and/or to the DKBmed Content; (iv) decompile, reverse engineer, or disassemble the App; (v) modify the App or the DKBmed Content, or create derivative works based upon the App or the DKBmed Content or (vi) use the App or the DKBmed Content for commercial use.

    You also acknowledge that

  4. Ownership

    You acknowledge and agree that: (i) the App and its component elements (including but not limited to the software, system design, page layouts and overall "look and feel") are protected under various intellectual property laws and owned or controlled by DKBmed LLC; (ii) this AGREEMENT confers only a limited License to access and use the App and the DKBmed Content for the limited purposes set forth in this AGREEMENT; (iii) as between YOU and DKBmed, all rights in the App, and the DKBmed Content, including but not limited to all intellectual property rights, are owned by DKBmed; (iv) the App may not be reproduced without DKBmed’s permission; and, (v) the algorithms, concepts, procedures and processes contained in the App are confidential and the App contains proprietary information, including but not limited to trade secrets, which YOU agree to maintain in confidence and treat accordingly.

  5. Termination

    The License granted herein is effective until terminated. The License will automatically terminate without notice upon the earlier of: (i) a breach by YOU of any of the terms and/or conditions of this AGREEMENT; or (ii) the nonpayment when due of any outstanding monies owed by YOU to DKBmed. You acknowledge and agree that DKBmed may elect to modify the App, or cease offering the App at any time, in which case the License will automatically terminate without notice. Moreover, the License will automatically terminate upon: (a) DKBmed’s written termination of this License; (b) the deletion of the App from your personal electronic device; or (c) your written notification to DKBmed that YOU are terminating the License. Upon termination of the License, YOU will delete the App downloaded pursuant to such License from all devices in your possession, custody and/or control, and shall destroy all copies of the DKBmed Content in your possession, custody and/or control.

  6. Disclaimer of Warranties and Technical Support

    Access to and use of the App is provided by DKBmed on an “AS IS” basis, with all faults, without any maintenance, technical support or warranty of any kind, including, without limitation, any warranty of merchantability, fitness for a particular purpose or non-infringement. You assume all risk associated with the installation and use of the App, including but not limited to the input and storage of patient data and the use of the information contained in the App.

    YOU AGREE TO TAKE ALL PRECAUTIONS AND SAFEGUARDS NECESSARY TO PROTECT YOUR DATA, AND SYSTEMS FROM LOSS OR DAMAGE.

    TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DKBmed SPECIFICALLY DISCLAIMS ANY EXPRESS OR IMPLIED WARRANTIES, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

    DKBmed DOES NOT WARRANT THAT THE APP AND/OR THE DKB CONTENT (THE INFORMATION AND MATERIALS CONTAINED THEREIN) WILL MEET YOUR REQUIREMENTS OR THAT YOUR USE OF THE APP WILL BE ERROR-FREE, UNINTERRUPTED OR HIPAA COMPLIANT.

    SOME STATES DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU. YOU MAY ALSO HAVE OTHER LEGAL RIGHTS WHICH VARY FROM STATE TO STATE.

    In the event of any failure of the Licensed Application to conform to any applicable warranty, YOU may notify Apple, and Apple will refund the purchase price for the Licensed Application to YOU; and, to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application; nor will Apple be responsible for any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application

  7. Limitation of Liability

    TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL DKBmed BE LIABLE UNDER ANY CIRCUMSTANCES FOR ANY DAMAGE OR LOSS, WHETHER SUCH BE DIRECT, INDIRECT, SPECIAL, PUNITIVE OR INCIDENTAL, OR FOR CONSEQUENTIAL DAMAGES OR LOSS (INCLUDING DAMAGES FOR LOSS OF BUSINESS, LOSS OF PROFITS, LOST SALES OR THE LIKE), WHETHER BASED ON BREACH OF CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY, EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, LOSS OF DATA, LOSS OF USE, BUSINESS INTERRUPTION, OR COST OF COVER, ARISING FROM THE USE OF THE APP, HOWEVER CAUSED, UNDER ANY THEORY OF LIABILITY OR OTHERWISE, EVEN IF DKBmed OR ITS REPRESENTATIVES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES ARISING UNDER THIS AGREEMENT OR FROM YOUR ACCESS OR USE OF, OR ATTEMPTED ACCESS OR USE OF, THE DKBmed CONTENT, THE APP, AND/OR ANY INFORMATION OR MATERIALS CONTAINED THEREIN. This limitation of liability is a fundamental element of the AGREEMENT between DKBmed and YOU. You agree that DKBmed would not be able to provide the App on an economic basis without such limitations.

  8. Indemnity

    To the fullest extent permitted by law, YOU agree to indemnify, defend and hold harmless DKBmed, and its affiliated entities, licensors and suppliers, and each of their respective owners, officers, directors, employees and agents (the “DKBmed Indemnified Parties”) from and against any and all claims, demands, losses, liabilities, damages, costs and expenses (including but not limited to attorneys’ fees) arising from or in connection with: (i) your use of the App and/or of the DKBmed Content and/or (ii) any violation of these Terms and Conditions. You agree that your representations and warranties, and your obligation to indemnify DKBmed Indemnified Parties shall survive beyond any term that this AGREEMENT is in effect.

  9. Medical Information

    The information provided through this App is intended for educational purposes only and should not be construed as medical advice and/or medical diagnosis, treatment and/or opinion. Each of the medical professionals accessing the App should exercise his or her own professional judgment as to the information provided through this App, and should conduct his or her own research and investigation with respect thereto.

    To the extent YOU seek to use the App in conjunction with any patient information or data (“patient data”), YOU must first create a password and log into the secure area of the App. You represent and warrant that YOU will comply with all federal, state and local laws, rules and/or regulations governing your use of the App and/or the use of patient data. You acknowledge and agree that DKBmed: (i) shall not have any access to any patient data, and (ii) expressly disclaims any liability arising from and/or related to such patient data, including but not limited to your input or use thereof.

  10. Acknowledgement

    This AGREEMENT is concluded between YOU and DKBmed and not with Apple. DKBmed, not Apple, is solely responsible for the Licensed Application and the content thereof. The AGREEMENT may not provide for usage rules for the Licensed Application that are less restrictive than the Usage Rules set forth for Licensed Applications in, or otherwise are in conflict with, the App Store Terms of Service as of the Effective Date (which DKBmed acknowledges it has had the opportunity to review).

  11. Product Claims

    DKB and YOU acknowledge that DKBmed, not Apple, is responsible for addressing any claims of YOU or any third party relating to the Licensed Application or YOUR possession and/or use of the Licensed Application, including, but not limited to: (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection or similar legislation.

  12. Intellectual Property Rights

    In the event of any third party claim that the Licensed Application or YOUR possession and use of that Licensed Application infringes that third party’s intellectual property rights, DKBmed, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.

  13. Legal Compliance

    YOU represent and warrant that (i) YOU are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a “terrorist supporting” country; and (ii) YOU are not listed on any U.S. Government list of prohibited or restricted parties.

  14. Third-Party Beneficiary

    DKBmed and YOU agree that Apple, and Apple’s subsidiaries, are third party beneficiaries of the AGREEMENT, and that, upon YOUR acceptance of the terms and conditions of the AGREEMENT, Apple will have the right (and will be deemed to have accepted the right) to enforce the AGREEMENT against YOU as a third party beneficiary thereof.

  15. General:

    1. This AGREEMENT shall be governed by the internal laws of the State of New York, without regard to the choice of law provisions thereof.
    2. Any dispute concerning this AGREEMENT and/or your use of the App and/or of the DKBmed Content shall be submitted to binding arbitration in New York within one (1) year from the date that the cause of action arose (or, if multiple cause of actions are involved, from the date that the first cause of action arose), with such arbitration conducted pursuant to the then prevailing rules of the American Arbitration Association. To the fullest extent permitted by law, no arbitration brought pursuant to these Terms and Conditions shall be joined to any other arbitration initiated pursuant to these Terms and Conditions. Notwithstanding anything to the contrary set forth in these Terms and Conditions, DKBmed may at any time seek injunctive or other appropriate relief against YOU and/or against others, in any state or federal court in the state of New York and in any other court having jurisdiction, in the event that DKBmed believes that YOU have violated or threatened to violate any of DKBMed’s intellectual property rights and, in such case, YOU hereby consent to the exclusive jurisdiction and venue of such court(s). This AGREEMENT shall not be governed by the United Nations Convention of Contracts for the International Sale of Goods, the application of which is hereby expressly excluded. This AGREEMENT is the entire agreement between DKBmed and YOU and supersedes any other communications, or advertising with respect to the App. If any provision of this AGREEMENT is held invalid or unenforceable, such provision shall be revised to the extent necessary to cure the invalidity or unenforceability, and the remainder of this AGREEMENT shall continue in full.
    3. This AGREEMENT contains the complete understanding between the parties with respect to the subject matter hereof, and supersedes all prior or contemporaneous agreements or understandings, whether oral or written.
    4. DKBMed and YOU agree that Paragraphs 3, 4, 6, 7, 8, 9, 11, 13,and 15 shall survive the termination of this AGREEMENT.
    5. DKBMed’s failure to enforce any provision of this AGREEMENT shall not constitute a waiver of any breach of such provision.
    6. You acknowledge that a breach by YOU of any of Paragraphs 2, 3, 4, 9 and/or 13 of this AGREEMENT would cause irreparable harm to DKBmed for which a remedy at law would be inadequate and therefore YOU consent to being enjoined from any such breach without requiring DKBmed to post a bond, to the fullest extent permitted by law, and in addition to all other remedies that DKBmed may seek at law or equity.
    7. All notices and communications to DKBmed hereunder shall be directed as follows:

    8. In the event any provision of this AGREEMENT is held invalid, illegal or unenforceable by a court of competent jurisdiction such provision shall be construed as if such invalid, prohibited or unenforceable provision had been more narrowly drawn so as not to be invalid, prohibited or unenforceable. If such language cannot be drawn narrowly enough to be valid, legal and enforceable, then that provision shall be severed from this AGREEMENT and the remaining provisions shall continue in full force.
    9. Each person executing this AGREEMENT on behalf of an entity represents and warrants that he/she has the authority to execute this AGREEMENT on behalf of such entity and bind such entity to the terms of this AGREEMENT.
    10. Nothing in this AGREEMENT will be construed to place the parties in the relationship of legal representatives, partners, joint venturers or agents, and neither party will have the power to obligate or bind the other in any manner.
    11. No waiver by DKBmed of any term or condition of this AGREEMENT shall be deemed a further or continuing waiver of such term or condition or of any other term or condition, and DKBmed’s failure to assert any right or demand compliance with any provision of this AGREEMENT shall not be deemed to constitute a waiver of any such right or provision.
    12. You are not permitted to assign or sub-contract this AGREEMENT or your rights under this AGREEMENT in whole or part to any other person. Any attempted assignment or subcontract in derogation of the foregoing shall be null and void.
    13. DKBmed’s current privacy policy can be found at DKBmed.com and is fully incorporated herein by reference. You agree not to provide DKBmed with any confidential information and/or patient data unless DKBmed agrees, in writing, to accept such information and/or data.
    14. Third-party trademarks, trade names, product names and logos (the "Trademarks") contained in or used by the Licensed Application do not constitute an endorsement or approval of such company or its products or services by DKBmed.
